Disputes

Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to or consolidated with an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
General
You acknowledge and agree that these Terms and Conditions, together with our Privacy Policy, constitute the complete and exclusive agreement between us concerning your use of the Website, and supersede and govern all prior proposals, agreements, or other communications relating to the subject matter herein.

Applicants approved for representation have the option to choose the advertising services offered – they are not required. If agency advertising is accepted and established; and an account number is generated, it is no longer an option at that time to receive a refund – as 3rd party services for maintenance of models’ profile, printing and marketing would have been paid for to a 3rd party company on models’ behalf by the agency and are not refundable.

We reserve the right, in our sole discretion, to change these Terms and Conditions at any time by posting the changes on the Website. Any changes are effective immediately upon posting to the Website. Your continued use of the Website constitutes your agreement to all such terms and conditions. We may, with or without prior notice, terminate any of the rights granted by these Terms and Conditions. You shall comply immediately with any termination or other notice, including, as applicable, by ceasing all use of the Website.

Nothing contained in these Terms and Conditions shall be construed as creating any agency, employment relationship, joint venture, partnership, or other form of joint enterprise between us. Our failure to require your performance of any provision hereof shall not affect our full right to require such performance at any time thereafter, nor shall our waiver of a breach of any provision hereof be taken or held to be a waiver of the provision itself or of any other provision hereof. In the event that any provision of these Terms and Conditions shall be unenforceable or invalid under any applicable law or be so held by any applicable court decision, such unenforceability or invalidity shall not render these Terms and Conditions unenforceable or invalid as a whole. We will amend or replace such provision with one that is valid and enforceable, and which achieves, to the extent possible, our original objectives and intent as reflected in the original provision.

Payments and Refunds

QBNW.com charges 20% on each booking for billing and payment handling to client and model. This fee is non-negotiable and non-refundable. As an ADVERTISING AGENCY this is NOT considered a “commission” as in a typical “modeling agency”. It is purely a handling charge for collection of payment due from marketing talent to hiring companies. QBNW.com is not responsible for any payment to a model until collected from the hiring company. QBNW.com – has NO AGENCY FEES and payments paid through QBNW to any 3rd party company for individual model profile maintenance is non-refundable.

NOTE TO ALL: QBNW.com cannot be held responsible for any downtime due to service errors, power outages, damaged/corrupted/lost email updates, network errors or hard drive crashes. QBNW.com takes no responsibility and is not liable for connections made through any link within this site. Staff and Management of QBNW.com have final decision without debate on acceptability of listings, postings to listings and category for placement within the website. Any talent listing not in keeping with our public viewing standards* for models may be placed in “active / not published” until it is brought up to quality standards. You would still be seen for bookings, just not on the public portion of our site. If your listing is missing an update submitted or you would like specific changes made – contact our agency manager and we should be able to correct the matter to your satisfaction with ease. Put your account number and 1st name on subject line of email.

*Models must provide seemingly “professional looking” images. Photos do NOT have to be professional, however “tacky photos” (not having or exhibiting an overall look that would attract a hiring client) will not be shown publicly on our site.
